These General Terms and Conditions govern the relations between "MUD HUNTERS" Ltd. and the users of the MudHunters.bg website regarding the use of the site, the purchase of UTV tours, gift vouchers, and other services offered.

By using the site and/or placing an order, the Client declares that they are familiar with and accept these General Terms and Conditions.

Hereinafter referred to as "MudHunters", "the Company", "the Organizer" or "the Merchant".

2. SUBJECT

MudHunters provides services related to organizing off-road UTV experiences, as well as the opportunity to purchase gift vouchers and other related services.

The main characteristics of the specific service, including duration, number of participants, included services, possibility of driving the machine, price, and other specific conditions, are described on the respective product page at the time of placing the order.

The information on the product page and the order confirmation form an integral part of the contract between the Client and MudHunters.

3. ORDER AND CONTRACT CONCLUSION

An order can be placed through the MudHunters.bg website.

Before completing the order, the Client has the opportunity to review the selected service, the number of participants, additional options, the final price, and the data provided by them.

By clicking the order completion button, the Client submits a binding request for the purchase of the selected service.

After a successful order, the Client receives a confirmation to the email address provided by them.

MudHunters reserves the right to contact the Client to clarify the date, time, number of participants, or other details when necessary for the performance of the service.

4. PRICES AND PAYMENT

All prices published on the site are final prices for the consumer, unless explicitly stated otherwise.

The price displayed on the site at the time of order completion is applicable.

Additional services or options selected by the Client may increase the final value of the order. Before payment, the Client receives information about the total amount due.

Available payment methods are displayed upon order completion.

5. CONDUCT OF UTV TOURS

The specific meeting place and time for the tour are specified on the product page, in the reservation confirmation, or through subsequent communication with MudHunters.

Participants should arrive at the meeting point at least 20 minutes before the designated start time to allow sufficient time for preparation, equipment, and briefing. This requirement is also published in the current tour description.

Before the start of the tour, participants receive safety instructions and rules of conduct during the experience.

Every participant is obliged to follow the instructions of MudHunters' representatives at all times.

The Organizer has the right to refuse or terminate the participation of a person who creates a danger for themselves, other participants, staff, the machine, or other persons.

6. UTV DRIVING

Driving a UTV by a Client or participant is permitted only when this is included or additionally purchased with the respective service.

For driving, the participant must be at least 18 years old and hold a valid category B driving license, a requirement also specified on the product page.

Before driving, the participant is obliged to undergo the provided briefing.

MudHunters may refuse to allow a participant to drive when, in objective assessment, there is a safety risk, including non-compliance with instructions, aggressive or dangerous behavior, use of alcohol, narcotics, or other intoxicating substances, or other condition incompatible with safe driving.

7. ALCOHOL AND INTOXICATING SUBSTANCES

Driving a UTV by a person under the influence of alcohol, narcotics, intoxicating substances, or medications that can significantly affect the ability to drive safely is not permitted.

In case of reasonable doubt, MudHunters has the right to refuse driving or participation when necessary to protect participants and other persons.

8. SAFETY AND EQUIPMENT

UTV tours are off-road activities conducted on uneven terrain and under conditions that may include mud, water, dust, rocks, inclines, vibrations, and sudden changes in motion.

Participants must use the provided or required protective equipment and follow the Organizer's instructions.

The Client is obliged to inform MudHunters in advance of circumstances that may make participation unsuitable or require special attention.

If in doubt about physical fitness to participate, it is recommended that the Client seek appropriate medical advice before booking.

9. WEATHER AND OTHER CONDITIONS

UTV tours are conducted outdoors, and their execution may be affected by weather conditions, route condition, technical condition of the machine, or other factors related to safety.

MudHunters has the right to change the route, start time, or postpone the tour when necessary due to safety, bad weather conditions, technical reasons, access restrictions, or other objective circumstances.

If, at MudHunters' initiative, the tour cannot be conducted, the Client is offered a new suitable date or a refund of the paid amount for the unfulfilled service.

10. DELAY AND NO-SHOW

The Client is responsible for arriving at the specified time and place.

In case of significant delay, MudHunters cannot guarantee the conduct of the tour with its full originally planned duration when this would affect other reservations or the safety of the conduct.

In case of inability to attend, the Client should contact MudHunters as early as possible using the published contacts.

11. CANCELLATION, ANNULLMENT, AND RESERVATION CHANGE

When the service is an entertainment activity booked for a specific date or specific period, the statutory 14-day right of withdrawal from a distance contract does not apply in cases provided for in Article 57, item 12 of the Consumer Protection Act.

This does not limit MudHunters' voluntary ability to allow a change or rescheduling of the reservation.

If a change is desired, the Client should contact MudHunters as early as possible. The possibility of change depends on available dates and the specific conditions of the reservation made.

For products or vouchers where a specific date for the entertainment service has not been determined at the time of purchase, the right of withdrawal is assessed according to applicable consumer legislation and relevant legal exceptions.

12. GIFT VOUCHERS

A gift voucher entitles its holder to use the service described in the voucher and/or on the product page.

The voucher can be used with a prior reservation and subject to availability.

The validity of the voucher, when limited, is indicated on the voucher itself, the product page, or the order confirmation.

Additional services not included in the voucher's value are paid separately.

In case of a lost code or a problem with a voucher, the Client can contact MudHunters by providing data through which the purchase can be identified.

13. RESPONSIBILITY OF PARTICIPANTS

Each participant is obliged to take care of the provided equipment and to use the UTV machine only in the manner instructed by the Organizer.

The participant is liable under the general legal order for damages caused intentionally or as a result of non-compliance with the provided instructions.

MudHunters is not liable for damages that occurred directly as a result of willful non-compliance with safety instructions by the participant.

Nothing in these General Terms and Conditions limits or excludes MudHunters' liability that cannot be limited or excluded under applicable law.

14. PHOTOS AND VIDEOS

During the tours, photos and videos may be created.

When a participant can be clearly identified and the materials will be used for marketing purposes, their use must be carried out with an appropriate legal basis.

Upon specific request regarding a published photo or video, the Client can contact MudHunters.

15. PERSONAL DATA

When using the site and placing an order, MudHunters may process personal data necessary for processing the order, payment, communication with the Client, performance of the service, and compliance with legal obligations.

Detailed information on the processing of personal data should be provided in a separate Privacy Policy.

16. INTELLECTUAL PROPERTY

The content of MudHunters.bg, including texts, photos, videos, graphic materials, logo, design, and other materials, is protected by applicable law.

Copying, distributing, or using for commercial purposes without the consent of the respective rights holder is not permitted, except in cases provided by law.

17. COMPLAINTS AND GRIEVANCES

Consumers have the right to file complaints with the Commission for Consumer Protection (CCP) and, where applicable, to use an alternative dispute resolution procedure through a competent conciliation commission. The CCP maintains an electronic system for submitting complaints and conciliation proceedings.

The old text, still found in many Shopify templates regarding the European ODR platform, should not be added: the platform was definitively terminated on July 20, 2025.

18. CHANGES TO THE GENERAL TERMS AND CONDITIONS

MudHunters may update these General Terms and Conditions in case of changes to services, the site, or applicable legislation.

The terms applicable to a specific order are those in force at the time of conclusion of the contract, unless otherwise provided by law.

19. APPLICABLE LAW

For all matters not regulated in these General Terms and Conditions, the current legislation of the Republic of Bulgaria and the applicable law of the European Union shall apply.

Consumer rights provided to them by imperative legal provisions cannot be limited by these General Terms and Conditions.
